ITC Has Completed a Negative Preliminary Injury Determination in the Antidumping Duty Investigation of Hot-Rolled Stainless Steel Sheet in Coil-Black from Germany and Italy

The International Trade Commission of the Ministry of Economic Affairs (hereinafter referred to as the "ITC") made a negative preliminary determination in its injury investigation involving Hot-Rolled Stainless Steel Sheet in Coil-Black from Germany and Italy.
According to the negative preliminary determination, the ITC found that an R.O.C. industry is not being materially injured or threatened with material injury by reason of imports of Hot-Rolled Stainless Steel Sheet in Coil-Black from Germany and Italy that are allegedly sold in R.O.C. at less than normal value.
Under the jurisdiction set forth in the Implementation Regulation on the Imposition of Countervailing and Antidumping Duties, the MOEA shall make an investigation, conducted by the ITC, as to whether there is any injury to an R.O.C. industry. As a result of the MOEA"s negative preliminary determination, we transferred this case to the Ministry of Finance on March 17 for an official termination.
The public Chinese version of the preliminary injury investigation report is expected to be available after April 4, 2003 from the website http://www.moeaitc.gov.tw or from the office of the Investigation Division of the ITC.
FACTUAL HIGHLIGHT
Product Description: The imported product subject to this investigation is flat-rolled product of stainless steel, hot-rolled, without annealed and pickled, in coils ( Hot-Rolled Stainless Steel Sheet in Coil-Black ) of length 600 mm or more, thickness 10 mm or less which is generally used in the production of downstream stainless steel products such as Hot-Rolled Stainless Steel-No.1 and Cold-Rolled Stainless Steel-2D/2B/BA coil. The Hot-Rolled Stainless Steel Sheet in Coil-Black is manufactured to specifications such as ASTM A240-00, DIN 17440, JIS G4304 or G3187 of CNS 9263. The Hot-Rolled Stainless Steel Sheet in Coil-Black subject to this investigation is classified under subheadings 7219.12.10.10 and 17 other subheadings of the Customs Import Tariff and Classification of Import and Export Commodities of the Republic of China.
Status of Proceedings: 1.Type of investigation: Preliminary antidumping investigation. 2.Petitioner: Yieh United Steel Corporation (YUSCO) 3.Date of the institution of preliminary investigation by the ITC : January 16, 2003. 4.Date of the ITC hearing : February 25, 2003. 5.Date of the ITC vote: March 10, 2003. 6. Date of the MOEA determination being transferred to the Ministry of Finance: March 17, 2003.

Industry: 1.Number of producers during the period, January 1, 2002-September 30, 2002: three. 2.Location of producers' plants: Kaohsiung. 3.Employment of production and related workers during the period, January 1, 2002-September 30, 2002: 172. 4.Apparent R.O.C. consumption during the period, January 1, 2002-September 30, 2002: about 774,000 metric tons. 5.Market share held by the domestic like product during the period, January 1, 2002-September 30, 2002: about 87%.
